US Judge Orders Freedom of Abrego Garcia from ICE Custody

A court has ruled the prompt release of Kilmar Abrego Garcia from immigration custody, concluding his ongoing confinement is without legal authority.

"Since his release after erroneous imprisonment in El Salvador, he has been re-detained, again without lawful authority," Judge Paula Xinis wrote in her ruling.

The case originates in a mistaken deportation to El Salvador in March, which the government later acknowledged was an error. Following his repatriation to the United States to answer alien smuggling allegations, he was held in federal detention.

In her decision, the court noted that the government does not have a valid removal order, which prevents them from deporting Mr. Abrego Garcia "at this juncture."

Context of the Case

The court challenge center on conflicting claims. Whereas the former administration contends that Abrego Garcia is a affiliate of the MS-13 criminal organization, he categorically denies this claim.

He has also pleaded not guilty to the smuggling charges, which are part of a separate criminal case in Tennessee.

The judge, who was overseeing his challenge to removal in a Maryland district court, ruled that he must now comply with the terms of his release from jail in Tennessee. This decision shifts his supervision to the Tennessee court.
